I. Participation.

1. Promotion applies for
   • new customers who have not had any contract or use the cloud infrastructure of FPT HI GIO CLOUD.
   • old customers who already had an existing contract with FPT HI GIO CLOUD.
2. To be eligible to participate in the Promotion, You must:
   • be eighteen (18) years of age or older if you are an individual;
   • be legally established under the laws if you are the company or organization.
3. FPT reserves the right to verify the eligibility of all customers.

II. Acceptance

1. By using or attempting to use cloud infrastructure services together with backup-as-a-service (BaaS) of FPT HI GIO CLOUD from this offer (“Service”), you agree to accept and be bound by these terms and conditions.
2. 2.2 By participating in this offer you are accepting these Terms and Conditions and the Privacy Policy which can be found here: https://higio.net/frontend/en/privacy-policy. This Privacy Policy shall govern and apply to any data you submit while participating in this offer.

III. Offer Period.

Promotion is only available until November 2020. FPT HI GIO CLOUD has the right to cancel or change any promotion at any time without notice and in its sole discretion.

IV. Offers.

1. 4.1 FPT HI GIO CLOUD provides a free of charge 3-months trial version of the BaaS with the pre-set configuration and pre-defined capacity as follows:

2. Additional resources, exceeding the capacity of the offered packages, must be requested additionally and must be covered by your expenses.
3. You only have one (1) time free trial agreement.
4. At the end of the 3-months trial, you will be offered to continue using Service and sign a contract with FPT HI GIO CLOUD within the next 10 days. During this next 10 days, you still can access to your system and data, which stay safe and secured in FPT HI GIO CLOUD. If the free trial will be finished or expired without any notice about service termination from you, this promotion offer will be deactivated, and the service and its renewals will be charged at then-current rate.
5. After 10 days after the end date of the trial, if the customer decide to terminate using the service, FPT reserves the right to terminate your account and all of your data without the prior notice.

V. Redemption.

To use the services at the special terms, you must provide your contact information as instructed at https://higio.net/baas-promo/en or contact the Sales directly via hotline 1900 6973 and request a BaaS 3-months trial agreement with FPT HI GIO CLOUD, including acceptance of this Promotion Terms and Conditions.

VI. Conditions.

1. Promotion cannot be refundable or replaceable for any reason and shall not be speculated, transferred, auctioned or sold in any way.
2. Promotions may not be combined with any other offers unless explicitly noted. Promotion is non-transferable and is not redeemable for cash or gift cards unless required by law.
3. The value of this offer cannot be combined with any other payment method for purchasing which is not mentioned in this offer.
4. Any taxes are the sole responsibility of you.

VII. Contact.

Our sales team will contact via the e-mail address and the phone number provided by you during the Offer Period. Valid e-mail and phone number are required. Any email returned as non-deliverable will not be re-sent.

VIII. Complaints.

Any questions, complaints or comments about the promotion can be made in writing. Send them in a sufficiently stamped envelope to Lot 29B – 31B – 33B, Tan Thuan St., Tan Thuan EPZ, Tan Thuan Ward, District 7, HCMC. Please always include the name of the user. FPT will answer as soon as possible.

IX. Final Provision.

1. FPT reserves the right to modify or discontinue this Offer at any time without prior notice or compensation in the event of circumstances outside of FPT reasonable control and only where circumstances make this unavoidable.
2. FPT reserves the right to disqualify any registrations that appear to be fraudulent, incomplete, invalid or in breach of these terms and conditions in any way.
3. Offer is void where prohibited or restricted by law.
4. By participating in this promotion, you agree that FPT will have no liability whatsoever for any costs, damage, disappointment or losses of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of the discount, or from participation in this promotion. Nothing in these Terms and Conditions shall limit FPT liability in respect of death or personal injury arising out of its own negligence or liability arising out of FPT fraud.
5. In the unlikely event of a dispute in connection with this promotion, FPT decision shall be final. We may at our absolute discretion restrict who may enter into promotions for any reason.
6. The laws of Vietnam shall apply to this promotion and these Terms and Conditions.
